Disbursements

The usual disbursements incurred by a client in purchasing a property include:

Land Transfer Tax
This tax is payable by the Purchaser and is collected by the Land Titles Office at the time the title documents are presented for registration. The tax is a percentage of the purchase price. For example:

Mortgage Registration
The Land Titles Office charges a $69.00 fee for registration of a mortgage.

Building Location Certificate (Survey Certificate)
The usual charge imposed by a survey company in Winnipeg is approximately $375.00. These certificates set out the exact location of any buildings on a particular property and also show whether a particular building encroaches onto an adjoining property or whether a structure of an adjoining property encroaches onto your property.

Zoning Memorandum
This document, issued by the City of Winnipeg (for Winnipeg property) certifies that a particular property complies with zoning regulations as to side yards and alignments. The City of Winnipeg will not issue a Zoning memorandum unless City staff is provided with an original Survey Certificate that is not more than 1 year old. The City of Winnipeg imposes a fee of $53.00 to issue a Zoning Memorandum.

Tax Certificate
This document is also issued by the City of Winnipeg and certifies whether property taxes are paid. The City charges a $35.00 fee to issue this certificate.

Miscellaneous
McRoberts Law Office LLP charges $60.00 for file administration and storage. In addition, there may be additional expenses for courier, photocopying, facsimiles and Land Titles searches.

Prior to closing, we will provide an itemized statement of the monies needed to complete the purchase. If the Purchaser is obtaining a new mortgage in order to acquire the property, it is necessary for the purchaser to pay the vendor approximately 30 days interest. This interest payment will vary depending on the circumstances. There will also be an adjustment between the purchaser and vendor in respect to the property taxes. Taxes are applied to legal fees and most disbursements.
